Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the foodoo mobile application (the “App”) and the website at foodoo.fit (the “Website”), collectively referred to as the “Service,” provided by Individual Entrepreneur Marat Muslimov (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration

To access certain features of the Service, you may be required to create an account using Sign in with Apple, a Google account or an email address. Some features first work under a guest account tied to your device; signing in later moves what you logged as a guest to your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Description of Service

foodoo is an AI-powered nutrition tracking application that allows users to analyze food by taking photos or entering text descriptions. The Service provides estimated nutritional information including calories, macronutrients, and micronutrients.

The Service also lets you talk about food with other people: group chats you create or join by an invite link, channels with daily posts, and shared diaries for a child that the people who feed them keep together. Section 7 sets out the rules for these features.

Important: The nutritional information provided by the Service is generated by artificial intelligence and constitutes estimates only. It should not be considered medical advice. Always consult a qualified healthcare professional or registered dietitian for medical nutrition advice, especially if you have allergies, medical conditions, or specific dietary requirements.

4. Free and Premium Plans

4.1 Free Plan

The Free plan provides limited access to the Service, including up to 3 photo scans per day, unlimited manual food entry, and basic tracking features.

4.2 Premium Plan

The Premium plan is available as a monthly subscription ($2.99/month) or annual subscription ($29.99/year) and provides unlimited access to all features, including unlimited photo scans, AI nutritional advice, text-based meal analysis, widgets, Siri Shortcuts, HealthKit integration, and data export.

5. Payments and Subscriptions

All payments are processed through the Apple App Store or Google Play Store. By subscribing to Premium, you agree to Apple's or Google's terms and conditions for in-app purchases and subscriptions. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple ID or Google Play account settings.

Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.

6. User Content

You retain ownership of all content you submit to the Service, including food photos and text entries (“User Content”). By submitting User Content, you grant us a limited, non-exclusive, worldwide license to process, analyze, and store such content solely for the purpose of providing the Service and improving our AI model (using anonymized, de-identified data only). When you send something into a chat, this license also covers showing it to the people in that chat. You are responsible for what you share and must have the right to share it, including photos of other people.

7. Chats and Content You Share with Others

Chats are small closed groups. A message you send — words, a photo, a dish you chose to show, a poll, a shopping list or your taste — is visible to everyone who is in that chat now or joins it later, for as long as the chat keeps it. Anyone who has a chat's invite link can join it, so share the link only with people you want there. Nobody in a chat sees your food diary, totals or goals; they see only what you send. If pet mode is on, your pet may now and then add a short AI-generated line to a chat you are in.

We have no tolerance for objectionable content or abusive users. By using chats you agree not to send anything listed in Section 8. Every photo is checked automatically before it is delivered, and photos that do not pass are not shown to anyone. You can report any message (hold it and choose Report) and block any person; a blocked person's messages, and their pet's, disappear for you in every chat, and they cannot reach you with notifications. We review every report within 24 hours. When content breaks these Terms we remove it and may remove the person who sent it from chats or suspend their account.

Photos sent into chats are kept for 30 days and then deleted; you can also take back a message you sent, which deletes it, photo included. Channels are written by us and cannot be replied to. These rules apply equally to children's diaries shared with other carers.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Send other people sexual or nude content, graphic violence, hate speech or symbols, content that promotes self-harm, or content showing illegal drugs.
  • Harass, bully, threaten or spam anyone, or keep contacting someone who has blocked you.
  • Share another person's private information or photos without their consent, or any content involving the exploitation of minors.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Access the Service through automated means (bots, scrapers) without our prior written consent.
  • Circumvent any access limitations or usage restrictions of the Free plan.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

9. Intellectual Property

The Service, including its design, code, AI models, logos, trademarks, and content (excluding User Content), is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE NUTRITIONAL INFORMATION PROVIDED BY THE SERVICE IS ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. THE AI-GENERATED NUTRITIONAL ESTIMATES ARE APPROXIMATIONS AND SHOULD NOT BE RELIED UPON FOR MEDICAL DECISIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the App settings.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction of the Individual Entrepreneur Marat Muslimov, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
